Your Rights Under the Consumer Protection Act, 2019
The Consumer Protection Act, 2019 (replacing the 1986 Act) is the primary legislation protecting consumers in India. It covers defective goods, deficient services, unfair trade practices, misleading advertisements, and overcharging. The Act applies to purchases of goods and services for personal use โ it does not cover commercial purchases made for resale or further processing.
The Act guarantees six consumer rights: the right to safety, the right to be informed, the right to choose, the right to be heard, the right to seek redressal, and the right to consumer education.
Who is a "Consumer" Under the Act?
Under Section 2(7) of the Consumer Protection Act, 2019, a consumer is any person who:
- Buys goods for consideration (paid or promised), or
- Avails services for consideration (paid or promised).
It includes online purchases, subscriptions, and transactions on e-commerce platforms. The Central Consumer Protection Authority (CCPA) and e-commerce platforms are both covered under the new Act.
Where to File โ Which Consumer Forum?
Consumer disputes are adjudicated by a three-tier quasi-judicial system:
- District Consumer Disputes Redressal Commission (District Commission): Claims up to โน50 lakh. Complaint filed in the district where the opposite party's office is located or where the cause of action arose.
- State Consumer Disputes Redressal Commission (State Commission): Claims between โน50 lakh and โน2 crore. Also hears appeals from District Commissions.
- National Consumer Disputes Redressal Commission (NCDRC), New Delhi: Claims above โน2 crore. Also hears appeals from State Commissions.
Step-by-Step: Filing a Consumer Complaint
Step 1: Send a Legal Notice First
Before filing at the consumer forum, send a written complaint or legal notice to the seller/service provider giving them 15โ30 days to resolve the issue. Many disputes are settled at this stage. Even if not, the notice creates a paper trail that strengthens your forum complaint.
Step 2: Prepare Your Complaint
The complaint must contain:
- Name, description, and address of the complainant.
- Name, description, and address of the opposite party.
- Facts of the complaint and when and where it arose.
- Documents in support โ invoice, warranty card, correspondence, photographs, delivery records.
- Relief sought โ replacement, refund, compensation, or all three.
- Verification and signature.
Step 3: File Online or in Person
The Consumer Protection Act, 2019 introduced e-filing via the National Consumer Helpline portal (edaakhil.nic.in). You can file your complaint, pay the fees, and track the case entirely online. Alternatively, complaints can be filed in person at the respective District or State Commission office.
Step 4: Pay the Filing Fee
Filing fees are nominal: for claims up to โน5 lakh the fee is โน200; up to โน10 lakh it is โน400; up to โน20 lakh it is โน500; up to โน50 lakh it is โน2,000. For State Commission, fees range from โน2,000 to โน4,000. There is no fee for complaints up to โน5 lakh filed online via EDAAKHIL.
Step 5: Attend Hearings
After admission, the forum serves notice on the opposite party, which has 30 days to file a response. Hearings may be in-person or virtual. Under the 2019 Act, target time for disposal is 3 months for cases not requiring laboratory analysis and 5 months otherwise โ though in practice timelines vary.
What Relief Can You Get?
Under Section 39 of the Consumer Protection Act, 2019, the forum can order:
- Removal of defect in goods or deficiency in service.
- Replacement of defective goods.
- Refund of price paid.
- Compensation for loss or injury suffered.
- Compensation for pain, suffering, and inconvenience.
- Discontinuance of unfair trade practice.
- Punitive damages.
- Adequate costs to complainant.

Time Limit for Filing
